I recently saw a documentary about companies in India producing traditional herbal remedies for sale. They had received a notice from a large U.S. pharmaceutical company informing them that they were in violation of international intellectual property law, that the U.S. company held an international patent on the medicine, and that the Indian company should stop making the medicine.

I also read a paper on the effect of things like the TRIPS agreement on third-world countries. The article used Brazil as an example of a country where there was a desperate need for cheap medication, and the strict application of intellectual property rules would mean certain death for HIV positive Brazilians.

These kinds of situations show how, in IP (as many international regulatory regimes), the balance is in favour of the Western countries (especially the U.S.) and their companies.

It's also important to remember that IP laws typically differ between countries - hence Canada's ability to produce cheap generic drugs. But no ones asks "should the Canadians respect the intellectual property rights of U.S. companies"?

Should China respect the intellectual property rights of U.S. companies? I don't think so. Fairly negotiated agreements between China and U.S. could be made to ensure that the U.S. companies would not suffer from cheap production of generics in China, but that the Chinese would be able to have accessibility to affordable medicine. Shouldn't that be enough?

Should Chinese respect it?

My answer, hell no. The Chinese should steal as much intellectual rights whenever possible. That is the risk of moving your manufacturing plants to China, since you want cheap labor ... you will have to suffer the consequences.

The Chinese don't give a ***** about intellectual rights. Look at the Taiwanese technology companies. It's getting expensive to manufacture in Taipei, Taiwan so they move the plants into China but once you do that, the Chinese wants their people in on it too and when they leave, the Chinese government will back them up on a new venture.
